Introduction For A Business Ethics Essay Ethics in Business From a business perspective, working under government contracts can be a very lucrative proposition. In general, a stream of orders keep coming in, revenue increases and the company grows in the aggregate. The obvious downfalls to working in this manner is both higher quality expected as well as the extensive research and documentation required for government contracts. If a part fails to perform correctly it can cause minor glitches as well as problems that can carry serious repercussions, such as in the National Semiconductor case. When both the culpable component and company are found, the question arises of how extensive these repercussions should be. Is the company as an entity liable or do you look into individual employees within that company? From an ethical perspective one would have to look at the mitigating factors of both the employees and their superiors along with the role of others in the failure of these components. Next you would have to analyze th e final ruling from a corporate perspective and then we must examine the macro issue of corporate responsibility in order to attempt to find a resolution for cases like these. The first mitigating factor involved in the National Semiconductor case is the uncertainty, on the part of the employees, on the duties that they were assigned. It is plausible that during the testing procedure, an employee couldnt distinguish which parts they were to test under government standards and commercial standards. In some cases they might have even been misinformed on the final consumers of the products that they tested. In fact, ignorance on the part of the employees would fully excuse them from any moral responsibility for any damage that may result from their work. Whether it is decided that an employees is fully excused, or is given some moral responsibility, would have to be looked at on an individual basis. The second mitigating factor is the duress or threats that an employee might suffer if they do not follow through with their assignment. After the bogus testing was completed in the National Semiconductor labs, the documentation department also had to falsify documents stating that the parts had surpassed the governmental testing standards. From a legal and ethical standpoint, both the testers and the writers of the reports were merely acting as agents on direct orders from a superior. This was also the case when the plant in Singapore refused to falsify the documents and were later falsified by the employees at the have California plant before being submitted to the approval committees (Velazquez, 53). The writers of the reports were well aware of the situation yet they acted in this manner on the instruction of a supervisor. Acting in an ethical manner becomes a secondary priority in this type of environment. As stated by Alan Reder, . . . if they the employees feel they will suffer retribution, if they report a problem, they arent too likely to open their mouths. ( 113). The workers knew that if the reports were not falsified they would come under questioning and perhaps their employment would go into jeopardy. Although working under these conditions does not fully excuse an employees from moral fault, it does start the divulging process for determining the order of the chain of command of superiors and it helps to narrow down the person or department that issued the original request for the unethical acts. The third mitigating factor is one that perhaps encompasses the majority of the employees in the National Semiconductor case. We have to balance the direct involvement that each employee had with the defective parts. Thus, it has to be made clear that many of the employees did not have a direct duty with the testing departments or with the parts that eventually failed. Even employees, or sub-contractors, that were directly involved with the production were not aware of the incompetence on the part of the testing department. For example, the electrical engineer that designed the defective computer chip could act in good faith that it would be tested to ensure that it did indeed meet the required government endurance tests. Also, for the employees that handled the part after the testing process, they were dealing with what they believed to be a component that met every governmental standard. If it was not tested properly, and did eventually fail, isnt the testing department more morally responsible than the designer or the assembly line worker that was in charge of installing the chip? Plus, in large corporations there may be several testing departments and is some cases one may be held more responsible than another depending on their involvement. A process like this can serve the dual purpose of finding irresponsible employees as well as those that are morally excused. The fourth mitigating factor in cases of this nature is the gauging of the seriousness of the fault or error caused by this product. Since National Semi conductor was repeatedly being reinstated to the listed of approved government contractors, one can safely assume that the level of seriousness, in the opinion of For the contractor approval committees, is not of monumental importance. Yet one has to wonder how this case would have been different if the lack of testing did cause the loss of life in either a domestic or foreign military setting. Perhaps the repercussions would have come faster much more stringent. The fact that National Semiconductor did not cause a death does not make them a safe company. They are still to be held responsible for any errors that their products cause, no matter the magnitude. As for the opposition to the delegating of moral responsibility, mitigating factors and excusing factors, they would argue that the entity of the corporation as a whole should be held responsible. The executives within a corporation should not be forced to bring out all of the employees responsible into a public forum. A company should be reprimanded and be left alone to carry out its own internal investigation and repercussions. From a business law perspective this is the ideal case since a corporation is defined as being a separate legal entity. Furthermore, the opposition would argue that this resolution would benefit both the company and the government since it would not inconvenience either party. The original resolution in the National Semiconductor case was along these lines. The government permanently removed National from its approved contractors list and then National set out to untangle the web of culpability within its own confines. This allowed a relatively quick resolution as well as the ideal scenario for National Semiconductor. In response, one could argue that the entity of a corporation has no morals or even a concept of the word, it is only as moral and ethical as the employees that work in that entity. All of the employees, including top ranking executives are working towards advancing the entity known as their corporation (Capitman, 117). All employees, including the sub-contractors and assembly line workers, are in some part morally responsible because they should have been clear on their employment duties and they all should have been aware of which parts were intended for government use. Ambiguity is not an excusing factor of moral responsibility for the workers. Also, the fact that some employees failed to act in an ethical manner gives even more moral responsibility to that employee. While some are definitely more morally responsible than others, every employee has some burden of weight in this case. In fact, when the government reached a final resolution, they decided to further impose repercussions and certain employees of National Semiconductor were banned from future work in any government office (Velazquez, 54). Looking at the case from the standpoint of National Semiconductor, the outcome was favorable considering the alternate steps that the governmen t could taken. As explained before, it is ideal for a company to be able to conduct its own investigation as well as its own punishments. After all, it would be best for a company to determine what specific departments are responsible rather than having a court of law impose a burden on every employee in its corporation. Yet, since there are ethical issues of dishonesty and secrecy involved, National Semiconductor should have conducted a thorough analysis of their employees as well as their own practices. It is through efforts like these that a corporation can raise the ethical standard of everyone in their organization. This case brings into light the whole issue of corporate responsibility. The two sides that must ultimately be balanced are the self interests of the company, with main goal of maximum profit, and the impacts that a corporation can cause on society (Sawyer, 78). To further strengthen this need, one could argue that there are very few business decisions that do not a ffect society in way or another. In fact, with the plethora of corporations, society is being affected on various fronts; everything from water contamination to air bag safety is a concern. The biggest problem that all of us must contend with is that every decision that a business makes is gauged by the financial responsibility to their corporation instead of their social responsibility to the local community, and in some cases, the international community. This was pointed out on various occasions as the main reason why National Semiconductor falsified their reports. The cost that the full tests would incur did not outweigh their profit margins. Their business sense lead them to do what all companies want . . . maximum profit. In the opinion of the executives, they were acting in a sensible manner. After all, no executive wants to think of themselves as morally irresponsible. (Capitman, 118). The question that naturally arises, in debating corporate responsibility, is what types of checks and balances can be employed within a company to ensure that a corporation and all of its agents act in an ethical manner. Taking the example of the National Semiconductor case, one can notice many failures in moral responsibility. National Semiconductor would have to review its employees, particularly the supervisors, for basic ethical values such as honesty. example, ultimately it was the widespread falsification of the testing documentation that caused the downfall of National Semiconductor, not the integrity of their components. In the synopsis of the case it is never mentioned that the employees initiated this idea, it would seem that it was the supervisors that gave the order to falsify the documents. In order to accomplish this, the company executives would have to encourage their employees to voice their concerns in regards to the advancement of the company. Through open communication, a company can resolve a variety of its ethical dilemmas. As for the financial aspe cts of the corporation, it has to decide whether the long term effects that a reprimand from the government can have outweighs their bottom line. In other words, corporations have to start moving away from the thought of instant profit and start realizing both the long term effects and benefits. These long term benefits can include a stronger sense of ethics in the work force as well as a better overall society. To conclude, I must say that I agree with the use of mitigating factors in determining moral responsibility. A company, as defined by law, is only a name on a piece of paper. The company acts and conducts itself according to the employees that work in that entity. I use the word employee because in ethical thinking there should be no distinction of rank within a company. There are times when executives can be held directly responsible and at the same time, there are cases where employees are acting unethically without the executives knowing. Neither title of executive or emp loyee equates to moral perfection. Therefore, when a company has acted irresponsibly, its employees must be held liable in a proportionate amount. As for the future of ethics in business I would speculate that if employees started to think more in long term benefits and profits, many of the ethical dilemmas that we face today would be greatly reduced. As mentioned before, businesses today uses the measuring stick of profitability. There needs to be a shift to the thinking of total utility for the social community in order to weigh business decisions. Opponents would argue that this is a long term plan that require too many radical changes in the face of business. Also, there is no way that an industry wide standard can be set since there are too many types of corporations. Plus, companies have different needs and every moral rule is subjective according to the type of business that everyone conducts. In response, I would argue that although there are no industry standards that are f easible, it is possible for every company to examine their practices as well as the attitude of their employees. There will be companies that find that they are doing fine with employees that are aware of their moral values. Yet other companies will find that they do have areas that need improvement. It is steps like these that start implementing changes. Once a few companies start to see the benefits of changes, it can help to encourage other companies to follow suit. After all, as seen in the case of National Semiconductor, mistakes in one department can cause the deterioration of an entire corporation. A History of Napoleons Continental System During the Napoleonic Wars, the Continental System was an attempt by French Emperor Napoleon Bonaparte to cripple Britain. By creating a blockade, he had planned to destroy their trade, economy, and democracy. Because British and allied navies had impeded trade ships from exporting to France, the Continental System was also an attempt to reshape the French export market and economy. Creation of the Continental System Two decrees, that of Berlin in November 1806 and Milan in December 1807 ordered all allies of France, as well as all countries who wanted to be considered neutral, to cease trade with the British. The name ‘Continental Blockade’ derives from the ambition to cut Britain off from the entire continent of mainland Europe. Britain countered with the Orders in Council which helped cause the War of 1812 with the USA. After these declarations both Britain and France were blockading each other (or trying to.) The System and Britain Napoleon believed Britain was on the verge of collapse and thought damaged trade (a third of British exports went to Europe), which would drain Britain’s bullion, cause inflation, cripple the economy and cause both a political collapse and a revolution, or at least stop British subsidies to Napoleon’s enemies. Literary Analysis in the Scarlet Letter

Raven 1 In Nathaniel Hawthorne’s book, The Scarlet Letter, the phrase â€Å"Opposites Attract† does not always ring true. Such is the case between a young beauty and an aging scholar. Through Hawthorne’s use of figurative language and imagery, he creates a winter-spring relationship between the two characters Roger Chillingworth and Hester Prynne, which ultimately leads to Hester’s downfall. The character Hester Prynne’s unparalleled youthful beauty and passionate nature makes her the perfect embodiment of spring.Early on in the text, Hawthorne says â€Å"She had dark and abundant hair, so glossy that it threw off the sunshine with a gleam, and a face which, besides being beautiful from regularity of feature and richness of complexion, . . . †(50) This picturesque description of Hester is used to not only to show her beauty, but also how her beauty is so fresh and vibrant. Her hair being described as â€Å"glossy and abundant† alludes to her spring-like qualities because in spring, all plants and creatures are new and plentiful in number. Hester’s position as being a new mother also makes her symbolic of spring, because both represent fertility and new life.Hawthorne even goes as far as saying â€Å"†¦with the infant at her bosom, an object to remind him of the image if Divine Maternity†¦Ã¢â‚¬  (53) Hawthorne using this comparison portrays Hester as being a perfect representation of fertility, almost to a god-like degree. It is Raven 2 unquestionable that spring is the most benign and gentle season. Hawthorne almost directly states that Hester is spring when he says, â€Å"†¦Hester’s nature showed itself warm and rich; a well-spring of human tenderness, un-failing to every real demand, and inexhaustible by the largest. (146) This is why Hester’s demeanor and character also contributes to her embodying spring. Even by saying that her nature was warm, Hawthorne adds to Hesterà ¢â‚¬â„¢s symbolism, because spring is the first season where warmth is introduced; the warm quality it possesses is also why spring is considered â€Å"friendly†, because it is the savior after a cold, hard winter. Roger Chillingworth represents winter in every possible aspect. His demeanor and appearance both are strong evidence of how he symbolizes the season of cold.When he is examining Hester’s health in the jail, he had â€Å"†¦a gaze that made her heart shrink and shudder, †¦and yet so strange and so cold,.. † (67) His cold demeanor directly relates to how winter is the coldest of all the seasons. Even something as simple as his gaze made Hester’s heart, which is the warmth of spring, shudder and get smaller. This parallels how a winter frost can kill off the warmth and vibrancy of spring. Chillingworth’s appearance also contributes to him symbolizing winter.He is described as a â€Å"†¦man well-stricken in years, a pale, thin , scholar-like visage† (55) Winter is the season where things get old, barren, and start decaying. So Hawthorne purposely describes Chillingworth as old, pale, and thin to make the most obvious statement of how the man and season are so closely related. Chillingworth is anything but a thriving individual: being thin and pale, he possesses the attributes that a sickly, perhaps dying, would have. Chillingworth’s insatiable appetite for revenge against Dimmesdale also lends to him being seen as a representation of winter.Winter, by itself, is a symbol for wrath and revenge. So when Hawthorne says that â€Å"This unhappy man had made the very principle of his life to†¦revenge. †(232), he is showing the uncanny similarities between Chillingworth and winter. Raven 3 Finally, Chillingworth’s own name alludes to how he embodies winter. The first eight letters of his name spell out â€Å"chilling†, which can only be associated with the cold temperatures in winter. The vast difference between the two characters Hester Prynne and Roger Chillingworth leads to the rapid decline and incompatibility of their relationship and to Hester’s downfall.Chillingworth is quick to admit how unrealistic his expectations of their relationship are when he says â€Å"I, †¦- a man already in decay,†¦ what had I to do with youth and beauty like thine own! †(69) Chillingworth, describing himself as â€Å"a man already in decay† re-instills how he represents winter, which is the season where all things decay and die. He also says that â€Å"Mine was the first wrong, when I betrayed thy budding youth into a false and unnatural relation with my decay. (70) Hawthorne’s use of figurative language is ingenious when he describes Hester’s age as a â€Å"budding youth†. Flowers begin to bud at the beginning of spring, so by describing Hester’s youth as budding, Hawthorne gives Hester spring-like qualiti es. The combination of the two previous quotes explains why a relationship between winter and spring could never exist in harmony. Chillingworth and Hester are two completely different individuals; Chillingworth’s cold frost halted any hope of the seedling of love to grow within Hester’s heart.Chillingworth acknowledges this fact when he says â€Å"My heart was a habitation large enough for many guests, but lonely and chill, and without a household fire. †(69) In the end, a relationship between this pair could never work. Hester’s lack of love for Chillingworth led her to commit the sin of adultery, her ultimate downfall. When Chillingworth says â€Å"†¦ from the moment when we came down the old church steps together, a married pair, I might have beheld the bale-fire of that scarlet letter blazing at the end of our path! (69) it’s as if he knew that Hester would cheat on him all along. Hester’s downfall was inevitable because Chillingw orth could not make her love him due to them coming from two entirely different places: winter and spring. William Shakespearers work is admirable, but his central claim to be or not to be is despondent and faint-hearted. Hamletrs outlook on life is evaluated on an emotional level rather than financial, but how can somebody be content when their vision of life is completely twisted? When my grandfather was diagnosed with Alzheimers, he didnt let the disease define who he is and what he can and cannot do. He also knew he was near his deathbed, but he did not let that stop him from getting up e very morning to go work in the fields to be able to provide for my mother and her sisters. Even if he had to have somebody behind him 24/7 to make sure he didnt wander off elsewhere, he still did what he did, because he loved his family very much and knew he had to support them until the end of his days. I dont know how he managed to get out of his bed every day, but sure enough, he did. He just got up and continued with his life as if he were perfectly fine. Not once did he ever voice a complaint, and he never once let his condition run his life. My grandpars story, as well as Jobsrs and Ebertrs, are proof that even when tragic things in life happen, it isnt the end, and that your tragedies are not who you are and they should not dictate what you do and how much you are worth in this world. From Chris Jonesrs interview with Roger Ebert, we come to an understanding that unlike Hamlet, Ebert views life and death in a very optimistic way despite the calamity of his life. Chris Jones, a writer for Esquire Magazine, quotes Ebert, to make others less happy is a crime. To make ourselves unhappy is where all the crime starts (Jones 34). Roger Ebert was diagnosed with thyroid cancer in 2002, which was then successfully removed through surgery. In 2003, he underwent surgery to get rid of cancer in his salivary glands. His illness was killing him, but Ebert did not let it define him. The uncertainty of Ebertrs health impacts the way we see his attitude toward the value of life because it makes it seem like Roger Ebert is ready to live life to its fullest, regardless of how much time is left and his condition, and this would be apparent regardless of whether or not he beat out cancer. Surviving something like that is amazing, thus giving more meaning to living life fuller than befo re. Ebert continued his life as a film critic until his death. He didnt do what he did because he was forced to, but because he had a passion and truly loved what he did. The appreciation Ebert had for his life regardless of his illness and hardships he faced should get nothing but respect. It would be such a wonderful thing if we could all develop such a love and passion for something similar to Ebertrs love for movies and writing. Ebert states, its saving me when I am writing, my problems become invisible and I am the same person I always was (Jones 18). I cannot express my admiration for Ebertrs optimistic attitude. I truly believe that Roger Ebert has left a lasting legacy on the world, his courageous story has been imprinted into the hearts of many. Similar to Roger Ebert, Steve Jobs is another innovative, wise man and an amazing source of positivity. Stanford Universityrs graduating class of 2005 received such an amazing and truly inspiring speech from Steve Jobs. Steve Jobs was the chairman, chief executive officer, and co-founder of Apple Inc. He delivered a speech based around one simple phrase, youve got to find what you love, (Par. 15). In his speech, Jobs mentions how as soon as he began to live in fear due to his failures, he did what he could to change it right away. He obtained that personal drive within him to get him to accomplish his goals. His speech reminds us that we are capable of achieving anything we set our minds to, no matter how big, no matter how small. He encourages us to believe in ourselves and achieve wonderful things because the world will always need us. In addtion, he tells the graduates about three different stories in his life, all serving as valuable lessons titled: connecting the dots, love and loss, and death. He explains to the graduating students how important it is to follow your heart and that you have to trust that eventually, things will be okay. He compares finding the right occupation to choosing a lover, As with all matters of the heart, youll know it when you find it. And, like any great relationship, it just gets better and better as the years roll on (Par. 15). Nihilism is a philosophy for those who are sad, and also for those who are happy, it is a philosophical viewpoint arguing that life lacks objective meaning, purpose, or instinctive value. Basically, there is no point for anything and everything in the universe is simply coincidental. If life is meaningless, then that means that life is nothing, and nothing is something. However, it is up to each individual to define the meaning of their own lives, even if others find life to lack a purpose. To conclude, the most important thing in this life is attitude. To live a happy life, all you have to do is change your outlook on it, and think positively, do not focus on your financial situation or social status because the value of your life is so much more than that.
